Restricted Cultural Resource Information Access Agreement


I do hereby request access to Restricted Cultural Resource Information (RCRI) contained within the libraries, files, documents, and maps of the Texas Historical Commission. I understand that this information is confidential under state (Texas Government Code §442.007, Texas Natural Resources Code §191.004) and federal (Archeological Resources Protection Act of 1979 [16 USC §470aa et. seq.]) laws. In consideration of access to this information, I agree to:

  • Use this information only in compliance with the applicable state and federal laws and regulations (Texas Natural Resources Code §191.004, Texas Natural Resources Code §191.132 and §191.133, Federal Regulations 36-CFR-800, and the Archeological Resources Protection Act of 1979 [16 USC §470aa et. seq.] );
  • Supply one (1) copy of any publication resulting from the use of this information to the Archeology Division, Texas Historical Commission, P.O. Box 12276, Austin, TX 78711-2276;
  • Have the bibliographic references of any publication resulting from the use of this information credit the Texas Historical Commission; and
  • Use the information for the specific purpose intended and not redistribute or publish the information in its original form.

In addition, for consideration of access to the Texas Archeological Sites Atlas web site and database, I also agree to:

  • Use the Texas Archeological Sites Atlas in a responsible manner and in compliance with the applicable state laws and regulations (Texas Penal Code §33.02);
  • Not divulge or discuss any Atlas access codes (including user names and passwords) to any third party; and
  • Report any and all system security violations, whether actual or potential, to the Texas Historic Sites Atlas program manager.

I also certify that all of the information provided on or accompanying this document is correct.

This agreement is considered by both parties to be a binding contract. All information obtained pursuant to the user's access to the Texas Archeological Sites Atlas shall remain confidential unless subject to public disclosure under the Texas Open Records Law (Texas Government Code §552) or the Archeological Resources Protection Act of 1979 (16 USC §470aa et. seq.). Anyone misusing information obtained through the Texas Archeological Sites Atlas may be subject to prosecution under the Texas Penal Code (§33.02). The individual’s access to RCRI data and the Texas Archeological Sites Atlas shall be terminated upon use of the system in contravention of these laws.
